Copyright & DMCA Notice
1. Copyright Ownership
All content published on heustons.com — including but not limited to the written copy on coverage landing pages, the forethought question lists, the coverage component summaries, the process descriptions, the visual design, the brand mark, and supporting documentation — is the original work of Heuston's Insurance Services LLC ("Heuston's," "we," "us," or "our") and is protected under United States copyright law, including 17 U.S.C. § 102 and the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Copyright in this content arises automatically upon authorship and publication regardless of whether the content displays a formal copyright notice. We may also separately register certain works with the U.S. Copyright Office where appropriate for enforcement purposes.
2. Permitted Uses
You may, without prior written permission:
- Link to any page on heustons.com from another website, social media post, or document, provided the link does not falsely imply endorsement, sponsorship, or affiliation.
- Cite or quote brief excerpts (typically a sentence or two) for purposes that qualify as fair use under 17 U.S.C. § 107, including news reporting, commentary, education, or criticism — provided the excerpt is properly attributed to Heuston's Insurance Services LLC with a link to the source page.
- Save, print, or share individual pages for your own non-commercial reference.
3. Prohibited Uses
Without prior written permission from Heuston's, you may not:
- Reproduce, republish, or redistribute substantial portions of Site content on another website, in a publication, or in marketing materials.
- Use Site content, in whole or in part, to train artificial intelligence systems, machine learning models, or other automated systems.
- Scrape, harvest, or systematically extract content via automated means, including bot crawlers that disregard our robots.txt directives.
- Use any element of the Heuston's brand (name, mark, slogan, design elements) in a manner that creates a false impression of affiliation, sponsorship, or endorsement.
- Modify, adapt, or create derivative works of Site content for commercial purposes.
4. Reporting Infringement (DMCA Notice)
If you believe in good faith that material on heustons.com infringes a copyright you own or control, you may submit a written notice of claimed infringement ("DMCA Notice") to our designated agent identified in Section 7 below.
To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include substantially the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (typically a URL on heustons.com);
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address;
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
We will review properly submitted DMCA Notices and take appropriate action, which may include removing or disabling access to the allegedly infringing material. Knowingly submitting a materially false DMCA Notice may result in liability under 17 U.S.C. § 512(f).
5. Counter-Notification
If you believe material you submitted or maintain was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated agent that includes substantially the following:
- Your physical or electronic signature;
- Identification of the material that was removed or disabled and the location at which it appeared before it was removed or access to it was disabled;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if the address is outside the United States, the judicial district where Heuston's may be found), and that you will accept service of process from the person who provided notification of alleged infringement.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Heuston's may, in appropriate circumstances, terminate or restrict access to its services for users determined to be repeat infringers of copyright. We may also remove infringing material expeditiously upon receiving a valid DMCA Notice.
