Privacy Policy
1. Scope & Applicability
This Privacy Policy describes how Heuston's Insurance Services LLC ("Heuston's," "we," "us," or "our") collects, uses, discloses, and protects information collected through the website at heustons.com (the "Site"). By using the Site or submitting information through it, you acknowledge the practices described in this policy.
Heuston's Insurance Services LLC is an independent commercial insurance brokerage based in Tuckerton, New Jersey. We are licensed in New Jersey, Pennsylvania, New York, and the U.S. Virgin Islands. This policy applies to information collected through the Site. Information you submit directly to insurance carriers, or that carriers obtain in the underwriting process, is governed separately by those carriers' own privacy practices and applicable insurance privacy law (including but not limited to the Gramm-Leach-Bliley Act and state insurance privacy regulations).
2. Information We Collect
2.1 Information you provide
When you complete the submission intake form or otherwise contact us through the Site, you may provide:
- Name, business or DBA name, email address, telephone number
- State of operation and coverage line of interest
- Target policy effective date
- Free-text description of your operation and the coverage you are seeking
- Any additional information you choose to include in correspondence
2.2 Information collected automatically
Like most websites, our Site may automatically collect limited technical information when you visit:
- IP address and approximate geographic location derived from it
- Browser type, operating system, device type
- Pages visited, time on page, referring URL
- Date and time of access
This information is collected through standard server logs and, if enabled, a privacy-respecting analytics tool. We do not currently use third-party advertising trackers or behavioral profiling tools.
2.3 Information from third parties
In the ordinary course of placing insurance, we may receive information about your business and its insurance history from sources including: prior insurance carriers (loss runs, prior policies), motor vehicle records (MVRs) and the Federal Motor Carrier Safety Administration (FMCSA) where relevant, public records, and consumer reporting agencies. Information obtained for underwriting purposes is handled in accordance with applicable insurance privacy law.
3. How We Use Information
We use information collected through the Site for purposes including:
- Responding to your inquiry and preparing a submission to one or more insurance carriers
- Communicating with you about your submission, quote, policy, claims, renewals, and related services
- Coordinating with insurance carriers, surplus lines brokers, premium finance companies, and other parties involved in placing or servicing coverage
- Maintaining our books and records as required by N.J.A.C. 11:17 (and counterpart regulations in Pennsylvania, New York, and the U.S. Virgin Islands as applicable) and other applicable laws
- Detecting and preventing fraud and protecting the security of the Site
- Improving the Site and our services
4. How We Share Information
We do not sell your personal information. We share information only as necessary for the purposes described above, including with:
- Insurance carriers and surplus lines brokers we approach on your behalf
- Service providers who support our operations (for example, email hosting, agency management systems, document storage), under written agreements requiring confidentiality
- Regulators and law enforcement where required by applicable law, subpoena, or court order, including state insurance departments conducting market conduct or licensing reviews
- Professional advisors (legal counsel, auditors) as reasonably necessary for our operations
- A successor entity in the event of a merger, acquisition, or sale of assets, subject to confidentiality obligations
5. Cookies & Analytics
The Site uses minimal cookies, primarily to support core functionality (such as remembering form input as you complete it within a session). If we enable analytics, we use a privacy-respecting analytics tool that does not set persistent cross-site identifiers and does not transmit personally identifiable information. We do not use third-party advertising cookies or behavioral retargeting tools through this Site.
You can control cookies through your browser settings. Disabling cookies will not prevent you from using the Site, but may affect form behavior.
6. Retention
We retain submission and policy-related information for the period required by applicable insurance recordkeeping rules and for the period reasonably necessary to service active and prior accounts, defend potential claims, and comply with our legal obligations. In general, this means:
- Submission and policy records: retained at minimum for the period required by N.J.A.C. 11:17 and counterpart rules in other states where we are licensed
- Website inquiries that do not become accounts: retained for a reasonable period (generally not more than 24 months) for follow-up purposes, after which they are deleted or anonymized
- Server logs: retained for a short operational period (generally not more than 90 days)
7. Security
We use reasonable administrative, technical, and physical safeguards to protect information collected through the Site. The Site is served over HTTPS. Access to client information is limited to personnel with a business need. However, no method of transmission over the internet or electronic storage is fully secure, and we cannot guarantee absolute security.
If we become aware of a security incident affecting your information, we will notify you in accordance with applicable law (including, where applicable, N.J.S.A. 56:8-163 and any other state breach-notification statutes that apply).
8. Your Rights
Subject to applicable law, you may have rights with respect to information we hold about you, including:
- The right to request access to information we hold about you
- The right to request correction of inaccurate information
- The right, in some circumstances, to request deletion (subject to insurance recordkeeping obligations and other legal requirements that may compel retention)
- The right to opt out of certain communications
Some rights vary by state and by the nature of the information. To exercise a right, contact us using the information in Section 11.
9. Children's Privacy
The Site is intended for business and adult users. We do not knowingly collect information from children under 16. If you believe a child has provided information through the Site, please contact us so we can take appropriate action.
10. Changes to This Policy
We may update this policy from time to time. The "Last Updated" date at the top reflects when changes were made. Material changes will be reflected on the Site. Continued use of the Site after changes are posted constitutes acceptance of the updated policy.
