1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the website at heustons.com (the "Site"), operated by Heuston's Insurance Services LLC ("Heuston's," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Nature of the Site

The Site provides general information about Heuston's Insurance Services LLC and the commercial insurance lines we place. It is intended for prospective and current commercial insurance clients located in jurisdictions where we are licensed to transact insurance business.

Heuston's is licensed as an insurance producer in New Jersey, Pennsylvania, New York, and the U.S. Virgin Islands. The Site is not directed to, and is not intended for use by, persons or entities in jurisdictions where we are not licensed.

3. No Coverage Created

Important. Nothing on the Site constitutes a quote, binder, application, or amendment to any policy of insurance. Coverage is bound only by written confirmation from an insurance carrier. Submitting an inquiry, completing the intake form, or otherwise communicating with us through the Site does not create coverage and does not modify any existing coverage.

Coverage descriptions on the Site are general summaries provided for orientation purposes. Specific coverage, conditions, exclusions, endorsements, and limits are governed by the policy as issued and by applicable law.

4. No Legal, Tax, or Financial Advice

The Site provides general information only. It does not constitute legal, tax, accounting, financial, or other professional advice. Specific situations should be reviewed with qualified professionals familiar with the relevant facts and applicable law. References to statutes, regulations, ISO forms, or industry standards are illustrative and may not reflect current law or current form editions in your jurisdiction.

When you submit information through the Site (whether through the intake form, by email, or otherwise):

  • You acknowledge that material misrepresentation in connection with an application for insurance may void coverage and may have other legal consequences under N.J.S.A. 17:33A et seq. (the New Jersey Insurance Fraud Prevention Act) and counterpart statutes in other jurisdictions
  • You acknowledge that we may share submitted information with insurance carriers, surplus lines brokers, and other parties as necessary to evaluate and place coverage
  • You acknowledge that no agency or fiduciary relationship is established by submission alone; the broker-client relationship is established when we and you mutually agree to engage

7. Intellectual Property

All content on the Site — including text, graphics, logos, the "Heuston's" name, the H crest mark, and the overall site design — is owned by or licensed to Heuston's Insurance Services LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit Site content without our prior written permission, except as expressly permitted in Section 8.

8. Permitted Use

You may:

  • Access and view the Site for personal informational use
  • Print or save individual pages for your own reference
  • Share the Site URL with others

You may not:

  • Use the Site or its content for any unlawful purpose
  • Use automated tools (including scrapers, bots, or AI training crawlers) to harvest content from the Site
  • Attempt to gain unauthorized access to any portion of the Site, our systems, or related infrastructure
  • Interfere with the operation of the Site or with other users' access to it

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEUSTON'S DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SITE OR ANY CONTENT WILL MEET YOUR REQUIREMENTS, OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEUSTON'S, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE SITE IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Nothing in these Terms is intended to limit liability that cannot be limited under applicable law.

This limitation applies to use of the Site itself. Liability arising from a broker-client engagement, if and when one is established, is governed separately by the engagement, the policies placed, and applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Heuston's Insurance Services LLC, its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law; or (c) your violation of any third party's rights.

13. Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Ocean County, New Jersey, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these Terms from time to time. The "Last Updated" date at the top reflects when changes were made. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
